Lawsuit Filed to Block New U.S. DOL Salary Regulation
In last month’s (May 2024) issue of Library Worklife, we discussed the U.S. Department of Labor’s (DOL) release of its long-awaited final rule under the Fair Labor Standards Act (FLSA). The final rule, which is scheduled to take effect July 1, 2024, will expand overtime protections for millions of the nation’s lower-paid salaried workers by increasing the salary thresholds required to exempt a salaried bona fide executive, administrative or professional employee from federal overtime pay requirements.
According to this brief report, employers should take note of a recent lawsuit filed to block the implementation of the U.S. Department of Labor’s (DOL) new final rule to increase minimum salary levels required to satisfy exempt status for many employees. The lawsuit, Plano Chamber of Commerce v. U.S. Department of Labor, was filed in the Eastern District of Texas on May 23, 2024, and seeks an injunction against the DOL rule.
Employers are encouraged to continue to prepare to implement any changes that may be necessary to comply with the rule in case it goes into effect as scheduled. Employers should also monitor developments and seek legal counsel if necessary.
